New York age-verification: what to know about your order

As of April 22, 2024, the New York General Business Law § 391-oo (the “New York age-verification law”) restricts the sale of certain weight-loss and muscle-building dietary supplements — and over-the-counter diet pills — to New York customers under 18. It applies to both physical stores and online retailers shipping into New York. For online orders, the law requires a delivery method where an adult signs for the package and shows proof of age at delivery.

Which MitoQ products does this apply to?

This restriction applies only to products marketed for weight loss or muscle building, plus over-the-counter diet pills. It does not apply to foods (products carrying a Nutrition Facts panel). For MitoQ, the only affected product is MitoQ Longevity Creatine Complex. All other MitoQ products are unaffected and ship normally.

Who has to follow this law?

Any retailer selling covered products to New York customers — whether a physical store or an online shop — must verify that the buyer is at least 18 before completing the sale.

Can I still order these products online if I’m in New York?

Yes. You can still buy covered products and have them shipped within New York. If your cart contains an affected product, we’ll ask you to confirm your age at checkout, and your order will ship by a special adult-signature method. Because our carrier verifies age at 21 and older, you’ll need to present valid government-issued photo ID showing you’re at least 21 when the order is delivered. This delivery method carries an additional charge, shown in your cart before you pay.

Why did my shipping cost go up?

The New York age-verification law requires covered products to ship using a delivery method where the recipient signs and shows proof of age. This adult-signature service costs more than standard delivery, so a shipping surcharge is added on top of your normal shipping. The exact amount is set by our carrier and is shown in your cart before you pay.

I qualified for free shipping — do I still pay this extra charge?

Yes. Free shipping thresholds don’t cover the adult-signature delivery required for age-restricted products.

What ID do I need to show at delivery?

A valid government-issued photo ID with your date of birth — for example a driver’s license, passport, or military ID.

The law says 18, so why am I being asked for 21+ ID?

Although the law’s minimum age is 18, our shipping carrier verifies age at 21 and older at delivery. In practice, you’ll be asked to show valid government-issued photo ID proving you’re at least 21 when your order arrives.

What if I’m not home when delivery is attempted?

The carrier can’t leave the package unless an adult is there to sign. Depending on the carrier, a second delivery attempt may be made. For redelivery or pickup arrangements, contact the carrier directly using the details on your tracking notification.
